Summary of Occupational Safety & Health
(Safety and Health Committee) Regulations 1996
1. Came in force 1st January 1997
2. A Safety and Health committee in accordance with these regulations must be formed or reorganised itself by 30th June 1997
3. The regulations apply to a work place with more than 40 employees
4. The committee:

5. Inaugural meeting must be convened by employer - In the meeting, make known Safety and Health policies
6. Functions: - (see Part III of regulations)
|
assist in development of safety and health rules and safe systems of work; |
|
| review the effectiveness of safety and health programmes; | |
| carry out studies on trends of accident, near-miss accident, dangerous occurrence, occupational poisoning or disease; | |
| report to the employer of any unsafe conditions and practices together with recommendations for corrective actions; | |
| review the safety and health policies at the place of work; | |
| Hold meeting at least once in 3 months; | |
| Inspect place of work at least once in 3 months; | |
| Inspect place of work after any incident has occurred; | |
| Convene a meeting to discuss incident reports |
7. Incident reports to be kept for a minimum of 7 years
8. Quorum of meeting - Chairman, Secretary and not less than � of remaining members
9. Minutes of meeting to reach every member of committee 2 weeks after the meeting
10. Minutes of meeting to be kept by employer for a minimum of 7 years
11. Penalty for non compliance is RM5,000 or 6 months imprisonment or both
