Summary of Occupational Safety & Health

 

(Control of Industrial Major Accident Hazards) Regulations 1996

 

1. Came in force 1st February 1996

2. Regulations apply to all industrial activities except:

bullet

Nuclear installation;

bullet Installation under the armed forces;
bullet Vehicle or vessel use in transportation;
bullet

Industrial activity which involves less than 10 percent of the threshold quantity set out in Schedule 2 of the Regulations

3. Include quantities of substance whether in pure form, or part of mixture or preparation or present as by product

4. Quantities added for group of installations (inside 500m radius) belonging to the same manufacturer

5. Every manufacturer shall submit notification of Industrial Activity Form for existing installation

6. For new installations submit notification not less than a month before construction

7. Director General may determine if installation is a Major Hazard Installation (MHI) or not a MHI

8. Every employee shall:

bullet

co-operate with the manufacturer in complying with the regulations;

bullet act in such manner not to endanger himself or others;
bullet

notify manufacturer or DOSH officer if aware of potential hazard which can cause a major accident

9. Threshold quantity is specified in Schedule 2 of the regulations

10. For non-MHI (Quantity of hazardous substance is 10 to 100% of Threshold quantity or determine to be such by the DG) manufacturer must demonstrate safe operations, by:

bullet

identify the possible major hazards;

bullet take adequate steps to prevent any major accidents;
bullet take adequate steps to minimise consequences to people and environment;
bullet prepare and keep on-site emergency response plan;
bullet provide evidence that the above is done when requested by the DG

 

11. For MHI (Quantity of hazardous substance exceeds threshold or determine to be so by the DG):

bullet

Prepare and submit Industrial Activity Report by a Competent Person at least 3 months before commencing the activity;

bullet Not make any modifications in that is not consistent with the Industrial Activity Report until he consult a Competent person and resubmit a further report;
bullet Report to be updated every 3 years;
bullet Prepare and submit on-site emergency plan 3 months before commencement of industrial activity;
bullet Emergency plan to be prepared in consultation with a Competent person;
bullet Emergency plan to be updated once every 3 years;
bullet Prepare information on industrial activity and inform local authorities or port authority for them to prepare off-site emergency response plan;
bullet Provide information as to the hazards of the industrial activities to persons/public who may likely be affected by a major accident around the site;
bullet

The information to be supplied within 6 months of determination that the site is a MHI and information is to be updated and resupplied at regular intervals.

12. When a major accident occurs, the manufacturer shall immediately notify the local DOSH office

13. Penalty for manufacturer of non-compliance is a fine up to RM50k or jail term of not more than 2 years or both

14. Penalty for employee of non-compliance is a fine up to RM1k or jail term of not more than 3 months or both
